Terms and Conditions for Using the Platform

Welcome to the Hotel Plus platform (hereinafter: the “Platform”) operated by Spiro Creative Studio (hereinafter: the “Operator”).

The Platform enables customers to purchase tickets and vouchers for activities provided by third-party vendors (hereinafter: “Vendors”) under the terms, prices, and validity specified on the website.

The Platform also allows customers to purchase discounted access to activities under the conditions, prices, and validity periods as detailed on the site.

It is recommended to revisit these Terms periodically to stay updated on any changes. The Platform reserves the right to modify and/or update these Terms at any time. If you disagree with any of the terms, you may refrain from using the website and/or the services and products offered.

These Terms are drafted in masculine form for convenience only and apply equally to all genders.

Please read these Terms carefully and comply with them. They apply to all use of the website, including all of its pages and features, and are binding upon anyone who chooses to use the Platform in any way.

By browsing or using the Platform, you agree to be bound by all of the terms and conditions set forth herein.

The Platform is intended for personal use only. Commercial use is prohibited without prior written consent. For commercial use, please contact the Operator via the contact details provided in these Terms or under the “Contact” section of the Platform.

It is strictly prohibited to exploit the Platform and/or its content and/or information about other users or advertisers for sending spam, commercial messages, or other unsolicited communications. Users may not take any action to promote content or gain commercial advantage.

The Operator reserves the right to refuse or cancel any sale at any time and without prior justification or notice. The Platform may also remove or decline to publish any content, in whole or in part, at its sole discretion, without notice or explanation.

Disclaimer

Use of the Platform and its content is at the user’s sole responsibility. Users are expected to use the Platform reasonably and cautiously. Any publication, review, tip, link, or recommendation does not constitute a substitute for independent evaluation or verification.

The Operator shall not be held liable for any damage or loss resulting from the services offered on the Platform or their compatibility with users’ devices, nor for software or server malfunctions, third-party services, or any other dependency of the Platform.

The Platform provides Vendors with a tool to present their activities or services and serves solely as an intermediary. The Platform does not sell or supply services and bears no responsibility for them. The sole obligation of the Operator is to remove Vendors found to be unauthorized or who receive negative reviews.

The Operator shall not be liable for any damages or losses (including but not limited to bodily injury, property damage, loss, theft, or emotional distress), whether direct or indirect, resulting from products or services purchased via the Platform. Vendors alone bear full liability.

Purchasing Process

The Operator takes all necessary measures to protect user privacy and data confidentiality.

Transactions on the Platform are processed by a third-party payment gateway (hereinafter: “Payment Processor”). All personal and payment information is secured and encrypted by the Payment Processor in a secure credit card processing interface (IFRAME). Any issues regarding data security are the sole responsibility of the Payment Processor.

To complete a purchase, users must fill out an order form and provide their full name, email address, mobile phone number, ID number, and credit card details.

Discount vouchers must only be purchased after receiving written or verbal confirmation from the Vendor. Without such confirmation, the customer forfeits any refund rights.

In the event of false or incorrect information being provided, the Platform reserves the right to cancel the order.

Confirmation of the order and delivery of the voucher will occur only after payment authorization is received. Submission of the order form alone does not constitute a completed transaction. If confirmation is not received by email, please contact customer support.

Cancellation Policy

The Platform complies with all consumer protection laws. Nothing herein derogates from any consumer rights under the Consumer Protection Law (hereinafter: the “Law”) or related regulations.

If you wish to cancel a transaction, you may do so in accordance with the cancellation terms on the activity page by notifying the Vendor via email. The cancellation date shall be the date the email is received.

In case of cancellation, a cancellation fee of 20 NIS will apply unless the cancellation is due to a defect or non-conformity in the service, or a clerical error or good-faith omission, in which case no fee shall apply.

The right to cancel as described above does not apply to certain services as outlined in Section 14C(d)(2) of the Law, including services scheduled within seven days from the cancellation request or goods that cannot legally be returned.

Vendor Information

Content provided by Vendors is uploaded based on their declaration that the information is accurate and does not violate any third-party rights, including copyrights or privacy rights.

As a publishing platform, the Platform assumes no responsibility for damages resulting from any such violations.

If you believe that any content infringes your rights, you may contact the Platform via the “Contact” section, including the relevant URL, your email address, and additional contact information. Incomplete requests will not be processed. The Operator will review and act upon such requests at its discretion or in accordance with the law.

All vendor-related information, including credentials, accuracy of listings, and promotional materials, is provided by the Vendors and is their sole responsibility. The Platform does not guarantee or assume any liability for these representations.

Users are advised to conduct independent checks before engaging with any Vendor or relying on Platform content. The Platform does not guarantee the quality or accuracy of any information or service published.

Publication of promotional materials does not imply endorsement or recommendation by the Platform or its Operator. Users should act prudently and verify professional information independently.

Privacy and Data Usage

The Operator respects user privacy and views its protection as a priority. The following outlines how data is collected, stored, and used, and what rights users have regarding their personal information.

During registration and transactions, users are required to provide personal details. This and other non-personal data may be stored in the Platform’s database. If you do not wish to provide such information, you are advised not to use the Platform.

You may request at any time to have your information deleted from the Platform’s records. The Platform will not share this data with third parties without consent, unless legally required.

With your consent, the Platform may send promotional messages via email or other means regarding products, services, or offers that may interest you. You may opt out at any time by following the instructions in such messages.

The Platform may use collected data for monitoring, improvement, statistical purposes, and operational needs, including the use of cookies. If you do not wish to accept cookies, you may modify your browser settings or cease using the Platform.

While the Platform implements measures to safeguard data confidentiality, it cannot guarantee absolute protection from malicious attacks. If you do not wish to risk exposure, please refrain from using the Platform.

Intellectual Property

All intellectual property rights in the Platform and its content, including texts, design, layout, graphics, photographs, illustrations, logos, domain name, code, and any other element, are owned exclusively by the Platform.

No part of the Platform, including its name, may be used without prior written permission. Reproduction, publication, public display, sale, framing, or broadcasting without express consent is strictly prohibited.

Miscellaneous

The Operator may modify these Terms at any time without prior notice.

The Platform may be relocated, renamed, or discontinued at the Operator’s discretion.

The user agrees that any legal claim or demand against the Platform and/or its owners shall be subject to a limitation period of 36 months.

Exclusive jurisdiction for any dispute arising from or related to these Terms shall reside with the competent courts of the Sharon District, Israel.
